I was wondering if anyone knows if 5* Mihawk will be dropped on 40 stamina lv.

there is a 0% chance of the 5* version dropping unfortunately

Yes, no one drops its evolved form, not even raid bosses. The only advantage of the 40stam is the 100%drop, but always unevolved.
